On June 23, TASS hosted a press conference on the new supervision system of the Ministry of Emergencies of Russia, Director of the Department for Supervision and Preventive Work, Rinat Yenikeev.
From July 1, the relevant amendments to the legislation in the field of fire safety, determined by the Federal Law No. 248-FZ “On State Control (Supervision) and Municipal Control in the Russian Federation” and the accompanying law, which in this connection make changes to certain legislative acts, come into effect …
They are based on the principles of proportionality of interference in the activities of controlled persons and management of the risks of causing harm to legally protected values. Thus, the practice of continuous checks is canceled. Their frequency will be individualized for each facility, depending on the risk category.
The determining factor in assigning objects to categories will be the state of fire safety and the conscientiousness of the owners in matters of compliance with the necessary requirements. At the same time, rightholders can independently assess the legality of classifying buildings and structures in operation as belonging to the appropriate risk category and thereby participate in the fire safety system.
In turn, the work of the supervisory authorities will be optimized. Greater attention will be directed to high-risk facilities – inspectors will be less likely to visit buildings and structures of bona fide owners.
“All objects will be distributed according to risk categories. For each of them, the frequency of supervisory measures in the field of fire safety will be individually established. A significant number of objects will go into the low risk category, which will free them from scheduled inspections, ”R. Yenikeev specified.
Preventive work is a priority for the new surveillance system. Preventive measures include informing, summarizing law enforcement practice, issuing a warning, counseling, and a preventive visit.
A compulsory preventive visit is envisaged in relation to objects classified as high-risk categories, as well as objects of preschool and general education, children’s camps, social services with accommodation, provision of inpatient and sanatorium-resort medical care.
The list of control measures, in addition to the traditionally carried out on-site checks, will be supplemented by an inspection visit, an on-site inspection, random control and documentary inspection.
If it is necessary to respond promptly to violations of fire safety requirements that pose a real threat, the inspector can make an “inspection visit”. Its duration will not exceed one day and will not require advance notice. The inspection time will be reduced from 20 to 10 working days.
The main role is given to the possibility of using information technology. This reduces the costs of controlled persons and, at the same time, increases the effectiveness of supervisory activities. In turn, all this radically increases the transparency of the work of control bodies.
