An award ceremony for justices of the peace was held in Moscow, timed to coincide with the 20th anniversary of the creation of peace justice in the capital. Deputy Mayor of Moscow for Regional Security and Information Policy Alexander Gorbenko presented awards (letters of thanks) to a large group of justices of the peace.
The world justice system of Moscow
Justices of the peace are judges of general jurisdiction of the constituent entities of Russia, who exercise their powers on the territory of the judicial district as part of the judicial region. They are part of a single system of courts of general jurisdiction and occupy the position of the first link in this system.
In accordance with federal law No. 188-FZ of December 17, 1998, justices of the peace consider in the first instance:
– criminal cases on crimes for the commission of which the maximum punishment does not exceed three years in prison;
– cases on the issuance of a court order;
– cases of divorce, if there is no dispute about children between the spouses;
– cases on the division of jointly acquired property between spouses at a claim price not exceeding 50 thousand rubles;
– cases on property disputes, with the exception of cases on the inheritance of property and cases arising from relations on the creation and use of the results of intellectual activity, with a claim price not exceeding 50 thousand rubles;
– cases on property disputes arising in the field of consumer protection, with a claim price not exceeding 100 thousand rubles;
– cases of administrative offenses referred to the competence of a magistrate by the Code of the Russian Federation on Administrative Offenses and the laws of the constituent entities of the Russian Federation.
The world justice system in Moscow is the largest in Russia. 438 judicial districts have been created in the capital. They are located in 156 buildings with a total area of 90 thousand square meters. 438 justices of the peace are involved in the consideration of cases, 1314 employees work in their apparatus.
Over the past decade, the number of cases heard by justices of the peace each year has grown almost fivefold – from 358,000 in 2010 to 1,691,000 in 2020. This is more than 70 percent of all cases submitted to the Moscow courts of general jurisdiction. The average workload per magistrate is 367.6 cases per month.
In the first half of 2021, 99.96 percent of court decisions adopted by justices of the peace in Moscow remained unchanged after appealing to a higher instance. This is the highest indicator in Russia (the national average is 98.33 percent).
Ensuring the activities of justices of the peace
In accordance with the Federal Law of December 17, 1998, No. 188-FZ “On justices of the peace in the Russian Federation”, the material and technical support of the judicial sections of justices of the peace is carried out from the budgets of the constituent entities of the Russian Federation.
To ensure the activities of justices of the peace in the system of executive authorities of Moscow on November 20, 2001, a specialized department was created, which in 2020 was renamed into Department for the provision of activities of justices of the peace of the city of Moscow… The main task of the Department is to create the necessary conditions for the full and independent administration of justice.
Since 2011, the Moscow Government has selected premises to accommodate the sites of justices of the peace. Major and current repairs were carried out on 323 court sites with a total area of 64.5 thousand square meters.
We have purchased and delivered about 7,000 office equipment, 25,000 pieces of furniture and household appliances, 438 audio and video recording systems of court hearings, as well as safes, metal and filing cabinets. Installed 1400 units of air conditioning system.
In 2020, 3.1 billion rubles were allocated from the city budget for the material and technical support of court sites and the salaries of employees of the office of justices of the peace. In 2021, this amount was 3.4 billion rubles.
The financial support of justices of the peace is carried out from the federal budget – through the Office of the Judicial Department in the city of Moscow (a structural subdivision of the Supreme Court of the Russian Federation).
Court Site Security
Much attention is paid to ensuring the safety of justices of the peace and visitors. All 156 buildings are equipped with arched metal detectors. Security posts are equipped with complexes for the registration of visitors, allowing to identify, among other things, people with fake and invalid passports, as well as those on the wanted list.
Thanks to modern security systems, 102 people on the federal wanted list were detained, and more than 13 thousand items prohibited for carrying were identified, including gas and traumatic pistols, gas canisters, knives and others.
Moscow World Justice was one of the first in the country to switch to electronic document management, having connected to the system of judicial office work. Since 2018, justices of the peace have considered more than 820 thousand cases sent in electronic form. Since September 1, 2019, audio and video recording systems of court hearings have been installed in all court areas.
In October 2020, to submit documents to justices of the peace in electronic form on the portal mos-sud.ruthe “Personal Account” service was opened. During a pandemic, the innovation was especially in demand. Today, citizens without leaving their homes can send documents to the court and receive information about the consideration of cases. During the operation of the service, 66 thousand applications were received.
Since September 2021, the Personal Account service has become available on mos.ru.
In the future, it is planned to create electronic files, electronic archives and trainable decision support systems for judges; the use of video conferencing for meetings, training sessions and use in the procedural activities of judges; expansion of electronic document flow with departments; development of IP telephony and robotic assistants.
The introduction of advanced information technologies, including artificial intelligence technologies, into the activities of justices of the peace will minimize the use of manual labor, reduce the time spent by judges and staff members, and improve the quality and transparency of court proceedings.
Consideration of typical cases will be accelerated by 70 percent. And the development of electronic interaction with departments will save up to 300 million rubles in three years on postage, consumables and stationery.
World justice during a pandemic
During the COVID-19 pandemic, justices of the peace and their staff fully perform their functions, ensuring the smooth operation of court sites in Moscow. All registered cases and materials are considered in accordance with the schedule.
The procedure for visiting the judicial sites of justices of the peace has been partially changed. Participants in the processes are allowed into buildings with personal protective equipment. Access to court buildings for persons not participating in the proceedings is temporarily restricted. Acquaintance with the materials of the case and the issuance of documents are carried out by prior agreement.
The court areas were provided with masks, gloves, sanitizers, and bactericidal lamps. Thermometry is carried out at the entrance; many buildings are equipped with thermal imagers.
