The Federation Council approved the law on certification of residents of new territories as patent attorneys. The initiative was developed by the Russian Ministry of Economic Development. The document provides for a simplified procedure for returning to the profession of those who worked in this field at the time the regions were admitted to Russia.
“To become a patent attorney, you must be certified by Rospatent. It requires proof of at least two years of experience in providing services for the protection of intellectual property rights. You also need to pass an exam and confirm your knowledge of the law. After this, Rospatent makes a decision on whether or not to include the candidate in the register of patent attorneys,” commented Maxim Kolesnikov, Deputy Minister of Economic Development of Russia.
According to him, residents of new regions who have received Russian citizenship will be included in the register in a simplified manner – only based on the results of passing a free exam. Candidates’ work experience will be confirmed by the presence of a previously issued Ukrainian certificate of a representative for intellectual property matters.
New regions show good dynamics of registration activity. In 2023, applicants filed 41 invention applications and 343 trademark applications.
“Residents of new regions will be able to obtain the status of a patent attorney and start working this summer,” emphasized Maxim Kolesnikov.
The simplified procedure will be valid until January 1, 2026. The bill was prepared within the framework of the “Transformation of the Business Climate” mechanism. It is included in the roadmap following the meeting of the Council on Intellectual Property under the Chairman of the Federation Council of the Federal Assembly of the Russian Federation.
